Frequently Asked Questions about Divorce Mediation

  • What if I just got a lawyer and sued for divorce?

     

    While every case is different and this is always your right, litigation may not be the best route to go.

     

    First, it creates or continues an adversarial relationship with your spouse.  If there are kids involved, maintaining at least a minimal cooperative relationship will be important for the children and their development. 

     

    Second, litigation is more expensive and takes longer.  Third, when circumstances change after the divorce, items such as alimony and child support may need to be re-negotiated.  Keep in mind that litigation is always available to you -- even if mediation does not work for you.
