Frequently Asked Questions about Divorce Mediation

  • Do I need an attorney?

     

    While you have the right not to retain legal representation, I strongly advise that you at least have an attorney review the Memorandum of Understanding and Property Settlement Agreement.  An attorney will be a key member of your support team.  A review attorney can also help you sort through legal issues and questions and give you advice.  You will be making a number of difficult decisions and having a wide base of resources and support will be helpful to you.  You may also want to have an attorney with you when you appear in court.

     

    You do not need an attorney when you start mediation.  We will discuss selecting an attorney as part of the mediation process.

     

    I can provide you a list of mediation-friendly attorneys for you to consult with.  The couple cannot be represented by the same attorney and the mediator cannot act as an attorney for either party.  All of these represent conflicts of interests and violate numerous ethical rules.

     

    Note: If you are being abused or if you suspect your spouse is hiding or disposing of assets, you should consult with a lawyer immediately, regardless if you planning on mediating the divorce.
